Kenyan position on dual citizenship
The Constitution of Kenya 2010 made it lawful for Kenyans to to hold dual citizenship unlike during the old Constitution which prohibited dual citizenship.
Article 78 of the Constitution of Kenya 2010 stipulates who should and should not hold dual citizenship.
State officers and members of the defense forces are not allowed by law to hold dual citizenship;
However, Judges and members of Commissions such as Independent Electoral and Boundaries Commission (IEBC), Commission on Revenue Allocation (CRA), Public Service Commission and National Land Commission (NLC) among others are allowed to hold dual citizenship.
Any person who has been made a citizen of another country due to operationalization of that country’s law without ability to opt out is also exempted.
A person who holds dual citizenship must renounce the other country’s citizenship before taking up public office.
