Milimani law courts, Nairobi, will be out of bounds from Friday 26 August to pave way for hearing of presidential petitions following the closure order from the Judiciary. The courts will be closed for eleven days.

 

“All advocates, prosecuting counsels, clients, national police service, the prison service take note that Milimani law courts Chief Magistrate criminal court and Traffic Court will not be physically accessible due to the hearing of the Presidential Election Petitions as from August 26 to September 5, 2022,”

 

“Take further notice that all fresh pleas and certificate of urgency will be filed and handled at City Court. All matters scheduled for this period will be mentioned virtually for directions by the respective courts during the period,”  the notes issued by Judicially directed.

 

Nine presidential petitions have been filed at the Milimani law Courts to challenge the presidential results that declared William Ruto as the President elect. Ruto managed to attain the minimum of 50%+1 in the 2022 General Elections.

 

The petitions were filed by different individuals, including the Azimio la Umoja One Kenya coalition presidential candidate Raila Odinga and Martha Karua, his running mate. Odinga vowed that he will use all the peaceful channels to ensure he gets justice.

 

The other petitioners included Okiya Omtatah and Khelef Khalifa, Rueben Kigame, Juliana Chege, John Kamau, David Kairuki Ngari and Youth Advocacy Africa (YAA).

Eight of the petitions were against IEBC while one petition from Moses Kuria was against Raila Odinga. Kuria is suing Raila for getting involved in violence that was experienced at Bomas of Kenya during declaration of presidential winner.

 

The petitions at Milimani law courts will be heard by a panel of seven Judges led by Chief Justice Martha Koome and Philomena Mwilu, Deputy Chief Justice. The other five Judges include, William Ouko, Isaac Lenalo, Dr Smokin Wanjala, Njoki Ndung’u and Mohamed Ibrahim.

 

The Judges have up to 5th September to determine the credibility of the Presidential elections.

 

On the other hand, the respondents are expected to hand in their response by Saturday 26 August. Their will be a pre-trial conference on Tuesday after which hearing of the petitions will commence.

 

If the results are found legit, the president elect, William Ruto, will be sworn in on 12 September 2022.
